HERNDON shows that she is a minor about 19 years of age residing in Collin County and without any lawful guardian of her estate and is entitled to an estate of the estimated value of one hundred and fifty dollars in the State of Tennessee. That WILLIAM THOMPSON father of said minor is dead, her mother MARY THOMPSON does not reside in the State of Texas, and that JAMES HERNDON JR. has custody of said minor and resides in said Collin County. Wherefore he prays that he be appointed Guardian of the Estate of said minor.

Collin County To the Hon. County Court said County. J. P. SEIGLER temporary administrator of the estate of A. W. & C. M. MURRAY would represent to the Court that as such temporary administrator he has taken into his charge the effects of said estates which were liable to perish and cared for the stock which needed attention. That he has gathered about seven hundred bushels of corn off of said premises and has used about one hundred bushels in fattening said stock including pork hogs. That he has killed (?) six of said pork hogs. That on the (blank) day of December 1880 he sold to TAYLOR VERNOR 635 lbs. pork at 5 cts.= $31.75 & on the (blank) day [of] Jan.1881 to ASTON HOWELL 615 lbs. pork @ 5 cts. $ 30.75

Making a total for pork sold $ 73.60

And that on the 17th day of Jan. 1881 said Administrator sold three bales

of cotton the property of said estate to MR. ROUNDTREE for the sum of $149.15

And some of the legatees appearing in Court, it is considered by the Court that said Estate be distributed among the legatees of said estate in accordance with the terms of the will of said S. M. WILKINS deceased as follows to wit:

To VERENICE WILKINS the sum of One Thousand Dollars; To SUSANNAH L. SMOOT the sum of $94.50; To E. M. WILKINS the sum of $283.50; To S. J. WILKINS the sum of $236.25; And to T. A. WILKINS the sum of $236.25. And it further appearing to the Court that VERENICE WILKINS one of the legatees is willing to accept a transfer of the aforesaid notes in part payment of her legacy, it is considered by the Court that said executor is hereby authorized and directed to execute to said VERENICE WILKINS a transfer of the same and debit her legacy with the sum of $423.15. It is further ordered by the Court that upon the filing of the Vouchers from the above named legatees showing that they have received their legacies, as distributed by the Court, and the filing of a receipt for final costs that said executor is discharged from his trust and said administration closed.

J. H. MARTIN executor of the estate of S. M. WILKINS Decd. respectfully represents that: all debts against said estate have been paid. The inventory, exhibit and report heretofore filed by him in said estate, and to which he hereby refers for particulars, contain statements of all property that has come to his hands and the disposition of the same except one bay horse valued at $15.00 which died before sale.

The account herewith filed marked Exhibit A & made a part hereof, contains a list of the debts that have been paid. There are no debts and expenses against said estate, except the costs attending this final settlement.

He has in his hands two notes due the said Estate from the sale of land as follows $200.00 from AMOS HUGULY bearing 10% due 27th day Nov. $218.40 from J. M. LOVELACE bearing same interest & due same time. And the sum of $1429.84 in cash as shown from said Exhibit.

He refers to the will of testator for names of the persons entitled to receive said estate remaining on hand; that all of them except E. M. WILKINS who resides in Limestone Co. Texas & S. L. SMOOT who resides in Collin County Texas and all are adults.

That Mrs. VERENICE WILKINS one of the legatees is willing to accept the two notes herein before described at their face value in the settlement of her legacy. Wherefore he prays that due notice of the presentation of said account be given according to law. That upon trial the same be approved: That said executor be directed to transfer said notes to the said VERENICE WILKINS and pay over the money in his hands to the persons entitled thereto. That he be discharged from his trust and for general relief.

He states to the Court that he has on hand as appears from his report filed in this estate on the 23rd day of September A. D. 1878 the sum of three hundred ($300.00) Dollars $300.00. That since said date to wit: during the year A. D. 1879 He received from J. L. DOGGETT attorney of G. R. MARTIN the sum of six hundred & seventy five dollars $675.00 from interest that said G. R. MARTIN estate had in Virginia coming from MERADIT MARTINs Estate deceaseds brother. That the above $675.00 and the $300.00 that he has heretofore had is all the property of any kind that has come into his possession as executor of said estate. That he paid out to J. L. DOGGETT Attorney at Law the sum of Seventy Five Dollars for defending said estate in the suit of J. B. MARTIN vs. A. H. WEAVER in the District Court of Collin County and for representing said estate in the suit of B. A. MARTIN against said estate in County Court applying to set aside will $75.00. That he has paid to B. A. MARTIN widdow [sic] of G. R. MARTIN decd. three annual payments of $30.00 each as directed by his will and her receipts herewith attached marked exhibits a. b. c. $90.00. That he has paid J. W. Waddill clerk of the County Court of Collin County the sum of $14.00 as per voucher (d) Court costs in this estate $14.00. That he has paid G. R. YANTIS tax collector the sum of $3.23 as per Voucher Exhibit (e). That he paid L. W. OGLESBY tax collector as per Voucher Exhibit (f) $3.00. That he paid J. L. DOGGETT for making out this report the sum of $5.00/00 as per Exhibit (g) 5.00.

Total paid out $190.23


Take this $190.23 from the $975.00 reported as on hand in this report, leaves in my hands as said executor at this day the sum of $784.77. All of which is respectfully submitted this Feby 1st A. D. 1881.

The Petition of SUSAN BRADLEY would represent that she resides in Collin County & that she is the widow of THOMAS T. BRADLEY late of said County deceased. That said THOMAS T. D. 1881 seized and possessed of an estate real and personal over and above the exemption allowed by law of the estimated value of one Thousand dollars Consisting of horses cattle & town lots in the city of McKinney, all of which property is in Collin County. Your petitioner would farther represent that the said THOMAS T. BRADLEY is indebted to the sum of about two hundred dollars. Wherefore she says that a necessity exists for administration of said estate & that she is not disqualified to act as administratirix thereof. And said Administrator having produced in Court the receipt of said persons for said sum of money it is therefore considered adjudged and decreed by the Court that the final report of the said JOSEPH FORMAN administrator as aforesaid be and the same is hereby in all things approved and be recorded. That said succession be closed and said administrator forever discharged from his trust.

Your reporter JOSEPH FORMAN Administrator of the estate of D. C. FORMAN late of said County deceased would represent that he has sold and disposed of all the property belong[ing] to said estate and collected all debts due the same that he has collected and paid off the debts against said estate so far as the assets extend. Your reporter would further represent that the Inventory of said estate filed August 11th 1879 contains a list of all the property belonging thereto except 3 ½ bales of cotton, 78 bushels of wheat & 185 bushels of corn. Said inventory is here referred to and made a part of this report. Your reporter who refers to and adopts (?) his annual exhibit filed Sept. 1st A. D. 1889 which shows that your reporter has received from the sale of said cotton, wheat & corn and a claim on Masonic Lodge:

Leaving said estate indebted to him in the sum of 16.08

Your reporter would further represent that since his last report he has made sale of all the real estate belonging to the Estate of the said D. C. FORMAN as returned on his said Inventory except 6 acres in the C. F. M. GOODWIN survey in Collin County which he has conveyed to J. O. FLACK in pursuance to an order of you[r] honors Court made at the June term 1880 and 200 acres in the SANFORD BECK survey previously set aside by this Court as a homestead for the widow & minors and said land sold in the aggregate for the sum of $1715.00

That all the personal property belonging to said estate was set apart to the widow & minor children except 1 two year old bull which has either strayed or been stolen & two old wagon irons & 1/3 interest in an anvil vice & two hammers which reporter has sold for $15.00. DYE deceased the following tracts of land. Beginning at the S. W. cor. of 100 acres set apart to J. H. BOWMAN executor which is marked on map as lot no. 1. Thence South 22.75 chains to S. It is the opinion of your commissioners that lands set apart to the heirs of S. E. DYE as described in the foregoing plat and (illegible) is not capable of a fair and equal division among the distributees and therefore make this special report recommending that the same be sold and placing the appraised value at the sum twenty four hundred & seventy four ($2474.00) Dollars. It is also our opinion that the 273 acres of land belonging to the Estates of S. E. DYE and HENRY DYE both deceased situated in the W. P. ALLEN survey and directed to be partitioned by us is not capable of a fair and equal division among the distributees of said Estate; and therefore we make this special Report recommending that the same be sold and placing the appraised value of the same at Four hundred & five ($405.00) Dollars. Therefore they pray that this report be received and Commissioners discharged.

Information in writing by D. J. FAULKNER that LOU McMIN is a person of unsound mind. I, T. C. Goodner, County Judge of Collin County this day cause the said LOU McMIN to be brought before me and the County attorney of Collin County appearing for the State there upon came a Jury of six good and lawful men to wit: W. R. POWELL and five others who were duly empanelled and sworn who after hearing the evidence and the special issues submitted to them by the Court returned into Court the following verdict in answer to the interrogations propounded by the Court.

Information as required by law having been made in writing by Wm. CARTER SR. that Wm. CARTER JR. is a person unsound mind. I, T. C. Goodner, Co. Judge of Collin County on this day caused the said Wm. CARTER JR. to be brought before me and the County attorney appearing for the State and the said Wm. CARTER JR. appearing in person and announced ready for trial and a Jury of six good and lawful men to wit: W. B. HARRISON and five others who being duly empanelled and sworn and who after hearing the evidence adduced which I caused to be reduced to writing and who after mature deliberation returned into Court to wit:


Int. 1st Is Wm. CARTER the defendant of unsound mind?

Ans. Yes.


Int. 2nd If the Defendant is of unsound mind is it necessary that he should be placed under restraint?

Ans. Yes.


Inst. 3rd if you answer both of the foregoing questions in the affirmative, then what is the age and nativity of Defendant?

Ans. About 30 years old born in the State of Indiana.


Int. 4th How many attacks of insanity has he had and how long has the present attack existed?

Ans. Has about three attacks yearly for past six years. Present attack has existed about 24 hours.


Int. 5th Is insanity hereditary in the family of Deft. or not?

Ans. No


Inst. 6th Is the Deft. possessed of any estate & if so of what does it consist and its estimated value?

Ans. Twenty three acres of land, one horse and some money supposed value about $150.00.


Inst. 7th If the Defendant is possessed of no Estate are there any persons legally liable for his support, if yea named them.

CARTER be committed to the custody of the sheriff of Collin County to be by him confined until information can be obtained from the superintendant of the lunatic asylum at Austin Texas as to wheather [sic] he can be admitted into said institution or until released upon bond of relatives or friends as provided by Law.

T. P. T. McLEAN

Information as required by law having been filed by I. S. EWAN that T. P. T. McLEAN is a habitual drunkard. T. C. Goodner County Judge of Collin County caused the said T. P. T. McLEAN to be brought before him and the County attorney appearing for the State and the Said McLEAN appearing in person and by attorney announced ready for trial. Then came a jury of six good and lawful men to wit: JESSE SHAIN and Five others who were duly empanelled and the charge of the Court returned to consider of their verdict and who after mature deliberation returned into Court the following verdict to wit: We the Jury find the Defendant guilty.

It is therefore ordered by the Court that said Defendant T. P. T. McLEAN be and he is hereby adjudged a habitual drunkard.

ELIZABETH HARGUSS (sic)

Lunatic Information having been filed by R. R. W.SHANN (??) as required by law that ELIZABETH HARGUS is a person of unsound mind. The Hon. T. C. Goodner County Judge of Collin County on this day caused the said HARGUS to be brought before him and the County attorney appearing for the state and said ELIZABETH HARGUS appearing in person announced ready for trial. Then came a Jury of six good and lawful men to wit: J. D. ATKINSON and five others who were duly empanelled charged and sworn and who after hearing the evidence adduced returned into Court the following verdict in answer to the Special issues submitted to them to wit:


1st I[s] the Deft. ELIZABETH HARGUS of unsound mind? Yes.

2nd If the Dft. Is of unsound mind is it necessary that she should be placed under restraint? No.

3rd If you answer[ed] both of the foregoing questions in the

affirmative then what is the age and nativity of the Deft.
