The State of Texas I, JOHN FAIRES of said county being of sound and disposing mind and memory and
County of Collin desirous to settle my worldly affairs while I have strength so to do make this my last will and testament hereby revoking all others heretofore by me made.
Item 1st. I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life.
Item 2nd. I desire and direct that my Executors hereinafter appointed without delay pay all my just debts funeral expenses and expenses of administration out of the first money that may come into their hands of my Estate and that they cause all accounts claims and demands (?) whatever due my Estate.
Item 3rd.
I desire and direct that all my real and personal Estate except bonds notes and accounts be sold by my Executors hereinafter appointed at the Court house door in McKinney after giving timing notice at public Auction to the highest and best bidders this personal property on a credit of six months and real Estate on a credit of one two and three years in three equal installments with interest from the day of sale at the rate of ten per cent per…

…annum taking notes with good personal security and retaining lien on the lands besides to secure the payments of the purchase money. I direct that my farm lying about one mile west of McKinney containing (86) acres be sold as above (a bare?) in One lot that my farm situated about one half mile East of McKinney containing about 70 acres be sold as above specified in One lot and that my timber land situated about one mile East of McKinney on East Fork and adjoining said last mentioned farm be divided into two lots as follows by running a line from the SE corner of the far ground (?) tract due East to the East fork of the Trinity all my land lying north of said line to be sold as above specified in one lot and all south of said line sold as aforesaid in one lot my said Executors executing good and sufficient titles to the purchasers of said lands retaining lien as aforesaid.
Item 4th. As soon as all my Just and lawful demands against my Estate shall have been paid then I desire and direct that fast as all (?) money shall come to the hands of my said Executors belonging to my said Estate ensuing from the collection of bonds notes accounts or from the proceeds or said sales of real and personal property or from any source whatever that my said Executors shall pay over and deliver the same from time to time until all of my Estate shall have been paid over and delivered to the following named persons severally to be theirs their heirs and assignees forever to wit to my son J. J. FAIRES one eighth of all my Estate, to my son THOMAS C. FAIRES one eighth of all my Estate, to my daughter…

I hereby constitute and appoint my sons THOMAS C. FAIRES and J. LEE FAIRES executors of this my last will and testament with full authority to act either singular or jointly in the execution hereof and I direct that no action be had in the District Court or any other court in the administration of my Estate except to prove and record this will and approve the bond of the Executors.

GOODNER signed the instrument of writing purporting to be the last will and testament of said J. M. FAIRES dec. which said will was filed in the papers of this Estate on or about the 25th December 1878 that affiant and said GOODNER signed said will of said FAIRES at his instance as witnesses to said will in the presence of said FAIRES and in the presence of each other that at the time said FAIRES signed said will he was over the age of twenty one years affiant further states that at the time of the signing of said will by said FAIRES he stated that said (unreadable) in writing was his last will and testament and that at the time said FARIES signed said will he appeared and seemed disposed to witness to be of sound mind affiant further states that at the time he and said GOODNER signed said instrut[ment] in writing they were both over the age of fourteen years.

I hereby appoint G. W. CAMERON of McKinney Texas Executor of this my last will and testament and I desire that he take charge of all my property immediately after my death knowing that he will faithfully carry out my wishes as stated above an I further desire that there shall be no court proceedings and that the said CAMERON shall not be required to give bond as Executor hereof.
