LAIR Temporary Administrator of the Estate of THADEUS PARRISH [PARRIS] Decd. and made oath the foregoing and annexed list contains a full statement of all the property of said Estate that has come into his hand as such administrator that he has mad no sale of any of the property and the only expense he has been at was for Invoicing the Stock of goods amounting to about Twenty five dollars which has not yet been paid and attorneys plus and Court cost more of which are paid. Knowing the uncertainty of life and now being sane in mind I now make and declare this my last will and Testament.

 

First I Bequeath that my funeral Expenses and all Just debts that I may owe at the time of my death shall be paid out of the stock that I may then own provided that it does not take more than one half of said Stock and if it takes more than half the remainder shall be paid out of land not specially given to named parties.

 

Secondly I Bequeath to my wife MATILDA BECK all the lands I now own on the waters of Spring Creek and between Spring Creek and Rowlett’s Creek which includes the present Homestead said Lands lying in Collin & Dallas Counties during her natural life and after her death to my two daughters MARGARET BECK and MATILDA BECK to be equally divided between them. I further give to my said wife all of my household and kitchen furniture all my wagons carriages harnesses furnishings utensils, Horses Jacks Jennets, mules, cattle sheep goats and hogs and all ready money that may be on hand at my death provided that money on hand shall be applied to the payment of debts which I may owe at my death before Stock of any kind or lands not given to specially named parties.

 

Thirdly I give and Bequeath to my daughter JULIA ANN SANDERS all the lands I may own at my death on the East side of Rowlett’s Creek in and out of the M. R. FOSTER 640 acre survey.

 

Fourthly I give and Bequeath to my daughter SARAH ANN SALMONS all the lands I may own at my death in the MARY SCOTT survey of 640 acres which I own in partnership with J. M. SALMONS. I owning two thirds of said partnership land and J. M. SALMONS one third. I bequeathing the said two thirds of said lands to SARAH ANN SALMONS.

Fifthly I give and Bequeath to my Grandson DANIEL ROWLETTE SALMONS forty acres of land off the south end of a tract of land bought by me from THOS. TAYLOR lying on the forks of Pilot Grove Creek and East fork of Trinity River near what is known as Clear Lake.

 

Sixthly I give and Bequeath to the heirs of my son MANLY BECK dec’d., the Heirs of my daughter ELIZABETH McDONALD dec’d., my daughter SARAH ANN SALMONS, my daughter all the lands I now own in the forks of East fork of Trinity...

Seventhly I hereby Revoke the Gift of the Mill Machinery and every thing pertaining thereto and the Still and all the apparatus pertaining thereto and will and declare that the same shall be sold and the proceeds to be applied to the payment of my debts if should owe any at my death and if not I give the whole or any remainder after paying my debts to my wife MATILDA BECK.

 

Eighthly I hereby state and declare that my daughter MARGARET BECK and MATILDA BECK are the owners of Horses and cattle independently of my stock and hereby declare that nothing in this will is intended to interfere with said horses and cattle and if their Minority should vest any ownership in me of said stock I hereby give and Bequeath all of said stock to them respectively as they claim. I further declare and make known that my wife MATILDA is the separate owner of nine head of horses which nothing in this will is to interfere with---after reflection I give and bequeath to my daughter JULIA ANN SANDERS five hundred dollars out of any money that may be on hand at my death or any money that may be due me at that time any of the stock on hand after the payment of my debts or the lands given to the heirs of my children in the preceding part of this will and hereby revoke anything said in the preceding part of this will conflicting with the gift of the said five hundred Dollars and hereby authorize her to take the same out of any of the effects named at its apprised value. I hereby state by way of explanation that Lands herein before given to the heirs of my several shall be so divided as to give to the heirs of each of the children named taken collectively one share of the lands. State of Texas I, OLIVER HEDGECOXE, of said County of Collin being of sound and disposing mind and

County of Collin memory, and being desirous to settle my worldly affairs while I have strength so to do, do make this my last will and testament, hereby revoking all others heretofore by me made,

 

Item 1st For the purpose of avoiding the expenses and trouble of Administration, and to ensure correct and economical management and entire Justice to all my heirs I hereby grant and convey to my brother JOHN O. HEDGECOXE all my real and personal property also all debts, dues and chases in action due me or legally or equitably belonging to me of every nature and description, and to assign to him all such dues, debts and chases in action so as to enable him the said JOHN O. HEDGECOXE to sue for and collect the same in his own name, without letters testamentary or of administration, just as I could do. And the said JOHN O. is hereby released and exempted from the necessity of qualifying or giving bond as executor or administrator.

 

Item 2nd. It is my will to give to my wife LAURA HEDGECOXE all my live Stock of every kind that does not already belong to her, all my household and kitchen furniture, and that she have all the rents and proceeds of my portion of the farms, so long as she remains my widow.

 

Item 3rd. It is my will that my executor JNO. O. HEDGECOXE furnish ample means for the education for my two sons OLLIE and OTTO and the daughter of my brother FELIX, MARETTA HEDGECOX.

 

Item 4th. After a final adjustment of all my debts it is my will that a remainder of my estate be the same in money, lands, or other property, be equally divided between my three sons HENRY O. HEDGECOXE, OLIVER HEDGECOXE, and OTTO HEDGECOXE.

County of Collin Whereas I OLLIVER HEDGECOXE did on the 3rd of July 1871 being of sound and deposing mind make and declare my last will and testament signed by my hand and being now of sound and disposing mind and wishing to amend and add to said will, I now therefore make ordain and declare this as a codicil thereto viz, 1st Where as in the aforesaid last will I gave to my wife LAURA HEDGECOXE the income arising from the rentals &c of land there in mentioned, but it is not my will that she receive no income or rentals from said property or any other lands or property or any other lands or property of mine whatever. And further in said will I gave to her all my live stock X but now will that she receive only two head of each kind viz: two horses, two head of cattle etc. to be selected by her. And that my executor furnish her no money, nor other means besides the stock just above named out of my estate.

 

2nd. It is my will that this codicil be annexed to my above mentioned will and testament, that it be probated with it and taken as a part thereof to all intents and purposes. Whereby ratifying and confirming said will in all respects and every particular not conflicting herewith. Witness my hand this 20th day of August A. D. 1871.

1 Deed to the tract under head of Community Property Papers relating to the DOUGLASS BROWN Survey Abs. No. in Young Co. on 213 1/3 acres O. HEDGCOXE has been paying taxes as a locative interest.

 

Papers relating to the PHILLIPS VIVION Abs. No. 20 in Young Co. on 320 acres of which O. HEDGCOXE has been paying taxes as a locative interest.

 

Papers relating to 1 League & 1 Labor of land Cert. (?) is to be raised—in which O. HEDGCOXE has one fourth interest. Papers relating to the Lands of the Est. of JOSEPH S. (?) JOHNSON decd. two certificated procured (?) by O. HEDGCOXE under power of Ally from the heirs one for one third of one League the other for 1280 acres—to one half of which O. HEDGCOXE is entitled under the power of Attorney.

Notice is hereby given that F. J. VANCE has filed in my Office his Petition for Probate of the last will and Testament of DANIEL KLEPPER dec eased which will be acted upon at the next Term of the District Court of Collin County to be holden at the Court House in the Town of McKinney on the 3rd Monday in July 1872 when and where all persons interested may attend and contest the same if they see proper.

County of Collin I DANIEL KLEPPER of the aforesaid County and State being in sound mind and knowing the uncertainty of life do make this my last will and testament that is to say

 

1st I will that all my real estate (viz all my lands) shall remain undivided until my eldest (sic) becomes of Legal age at which time they my legal heirs shall take possession of the Same and Contrate (?) as they may see proper so to do.

 

2nd I will to my oldest son WM. A. KLEPPER one bay Mare 4 years old this spring, being the One which I had here tofore given him and is now claimed by him. Also to said WM. A. Two Cows, Two yearlings and one Two year old, the same being Stock which I had before given him and is now bound (?) and claimed by him.

 

3rd To my son JOHN W. KLEPPER One cow and yearling being the same which I had before given him and which is now recognized as his said JOHN W. cow & yearling.

 

4th To GEORGE PRICE KLEPPER my 3rd son I give one three year old heifer which has been before given to him.

 

5th I will and Set apart a sufficient amount of my horse (?) property which is most Salable to pay all debts-and the remainder of my horse (?) property- And…

…all of my cattle remaining to be sold on a credit of Twelve months and the proceeds thereof to be divided equally between my three oldest sons for their support and education at such times as their wants may require and my wagon and harness & all of my farming implements and my cooking stove to be sold on the same time and the proceeds thereof to be applied in the same manner as the property—last before mentioned and all the remainder of my household and kitchen furniture I will to my oldest son WM. A.

 

6th I further will that my farm and dwelling and all things thereunto pertaining shall be rented or leased for cash or for a part of the crop as may best suit for the interest of my heirs. (viz. the oldest as above named and that the proceeds of said Farm to be applied to the Keeping up the fencing around and the building on the same and paying Taxes also, and the balance after Keeping up said farm and paying Taxes as before mentioned to be divided and appropriated to my three oldest sons in the same manner as above Stated.

 

7th Having disposed of all my property I now will that no other action shall be had herein by the District Probate Court that the probating of this will.

 

8th I now will and appoint ISAAC K. KLEPPER my executor for the purposes of Carrying Out this my last will and testament my said Executor full power to carry out the same as therein stated with-out any order of court after the probating of the Same and confirming the appointment of said executor. To all persons interested in the Estate of WILLIAM T. ELKINS Dec’d—Notice is hereby given that E. F. ELKINS has filed in my office his application for Letters of Administration which will be acted up [on?] at the next term of the District Court of Collin County to be held at the Court House in McKinney on the 3d Monday in July 1872 when and where all persons interested may appear and contest the same if they see proper.
