                        Estate of JAMES HOWARD, Decd.

State of Texas   In County Court Pertaining to Estates

Collin County                 July Term, 1863

 

            To the Honl. Chief Justice of Collin County. The undersigned commissioners having been appointed by your honor to make partition and distribution of the Estate of JAMES HOWARD, deceased have discharged the duty assigned to them and submit the following report.

            To ABAGIL FORMAN the mother of said deceased, we have allotted the one half of said Estate consisting of a negro girl named Sarah Jane about eleven years old and one hundred and eighty one dollars and thirty six cents in confederate money. The negro and money according to our valuations amounting to $981.36

            The residue of said estate consisting of one hundred and sixty acres of land, balance on note of $145 39/100 dollars and 35 97/100 dollars in Confederate money we find incapable of division without manifest injury to Heirs named in the order to us directed the 160 acres of land we value at $800.00 balance on not $145.39 confederate money $35.97 amounting to$981.36.

Pegues being proceeds of sale of 2 mules sold by said deceased in his life time to the confederate government & collected by said Pegues                                                   $285.00

            First. I desire that my body be decently interred according to my station in life & the estate of which I may die possessed of.

            Second. It is my desire that no action be had in the County Court in relation to my estate, other than the probate & registration of my will & the return of an inventory of my estate.

            As to the property that God hath blessed me with I dispose of it as follows viz:

            Item. I give & bequeath to my beloved grand children, JANE E. TUMLINSON, ELVIRA TUMLINSON, JOHN M.             Item. I give & bequeath to my beloved wife ANNA an ample & competent support during her natural life to be set a part annually out of the proceeds of my estate.

            Item. I give & bequeath to my beloved wife ANNA all my household & kitchen furniture to have & to hold the same during her natural life & at her death to be equally divided between my two sons JOHN MILES COPE & JAMES COPE.

            Item. At my death I desire my funeral expenses & all my just debts to be paid out of the proceeds of my estate.

            Item. I give, devise & bequeath to my two sons JOHN MILES COPE & JAMES M. COPE all property not hereinbefore disposed of which I may die possessed, as well lands & slaves as all other my said property wheather (whether) real, personal or mixed not herein before disposed of, to be divided between my two said sons JOHN MILES COPE & JAMES M. COPE in equal proportions, the same to be holden by my said sons & their heirs forever.

            Item. I hereby nominate & appoint my two JOHN MILES COPE & JAMES M. COPE as executors to this my last will & testament & do hereby enjoin it upon them to carry out this my last will in all its provisions strictly & faithfully.

            This my last will & testament written on one sheet of foolscap paper in the County & State first above written on the fourteenth day of August in the year of our Lord One Thousand Eight Hundred and Sixty One.

                                    The last Will & Testament of

ALEXANDER W. JACKSON of Collin County of Texas. I, ALEXANDER W. JACKSON considering the uncertainty of mortal life and the certainty of death and being of sound mind and memory do make and publish this my last will and testament.

            1st. I want enough of my wild cattle sold to pay my debts.

            2nd. It is my wish that the property made by myself and wife since we have been married shall be equally divided between my children and herself.

            3rd. I will that a tract of prairie land held by me of 116 acres and also a tract of timbered land of 52 acres do to my children exclusively.

            4th. I will that the homestead farm deed to me by my wife be transferred back to her and at her death be divided between her children and min equally.

            5th. I wish the farm cultivated for the support of the children.

            6th. All money and notes which may be found deposited is to be equally divided between my wife and my children.

            7th. It is my special will that the County Court have nothing to do with my property personal or real except the recording of the same, and I hereby appoint my wife ANN ELIZABETH JACKSON my sole executrix of this my last will and testament.

            In witness Whereof I have hereunto set my hand and seal the 10th day of December in the year of our Lord One thousand eight hundred and sixty three.
