Now at this day comes CHARLES R. BREEDLOVE Administrator on the estate of J. M. & ELIZA BOUNDS Decd. by petition and prays the court to be relieved from the Administration of said Estate and it being proven to the Court that the Notices required by law has been given it is ordered by the Court that said CHARLES R. BREEDLOVE be and is hereby relieved of the administration of said Estate.

 

                        Estate of DAVID WETSEL Deceased

 

Now at this day comes CHARLES R. BREEDLOVE Administrator of the Estate of DAVID WETSEL Decd. by petition and prays the Court to be relieved of the Administration of said Estate and the Court being satisfied that the Notices required by law had been given it is ordered by the Court that the said CHARLES R. BREEDLOVE be and is hereby relieved of the Administration of said Estate and it further ordered by the Court on the petition of ALEX BERRY from (?) filed that said BERRY be appointed Administrator pro tem on the Estate of DAVID WETSEL Decd. with power to collect and pay over to S. M. BANDY widow of said Deceased a sum not exceeding Fifty Dollars of the assets of said Estate and to report his actions herein to the next term of the court.

Now at this day comes HUGH WHISENANT by petition and prays the court for the appointment of Administrator on the Estate of R. C. WHISENANT Decd. and it appearing to the Court that proper Notice had been given, Ordered by the Court that HUGH WHISENANT be and is hereby appointed Administrator of said Estate and that Letters be issued to him when he executes bond for the faithful performance &c.

 

                        Estate of A. B. PERRIN

 

At this day come the appraisers (?) appointed to appraise the Estate of A. B. PERRIN and made their report, ordered by the court that the report be received and that the same be recorded by the clerk.

 

                        Estate of A. B. PERRIN

 

Now comes ELLEN THOMAS Administratrix of the Estate of A. B. PERRIN Decd. and prays the court for an order of sale of sufficient property of the Same Estate to pay off the indebtedness of the Estate, Ordered by the Court that ELLEN THOMAS Admrx. Proceed to Sell Sufficient property belonging to said Estate at public outcry to the highest bidder for cash in hand for all sums of Five dollars &c under and Sums over that amount on Three months credit taking notes and good security.

 

                        Estate of RICHARD GRAVES

 

Now at this day comes MARY JANE GRAVES by petition and prays the court for the Probate of the last will and Testament of RICHARD GRAVES Decd. and prays to be appointed Executrix of the same, ordered by the court that the last will and testament of RICHARD T. GRAVES Decd. be probated, and that the said MARY JANE GRAVES be appointed as Executrix of the same and that Letters be granted her after she executes Bond for seven Thousand Dollars for her faithful performance of the same it is further ordered by the court that JOHN K.                         Estate of PETER E. ROBERTS Decd.

 

 

On this day comes DAVID B. DAVIS & MANDADAY DAVID Administrator & administratrix of the Estate of PETER E. ROBERTS Deceased by Petition praying the Court for an order to sell the Property belonging to said Estate to pay the indebtedness of and the expenses of Administration of said Estate and to have set apart certain property for the support of the widow & children of said Deceased as a part of her yearly allowance and to have set apart to the widow and children of said Deceased the property exempt from forced sale or Execution.

Ordered by the court that all property belonging to the Estate of PETER E. ROBERTS Decd. exempt from forced sale or execution be set apart for the use and benefit of the widow & children of said Deceased, also that the property prayed for by the Petitions to wit One (1) 1 year old Pony mare one 2 year old Blaso (?) mare and 4 year old Bay mare one shot Gun muls (mules?) & amles of wagon & one small set of wagon Irons br. (?) set apart for ino (?) support of the widow & children as a part of her yearly allowance further ordered by the court that a sufficient amount of Property belonging to said Estate be sold for cash in hand to public outcry to the highest bidder to pay the Expenses of Administration.

Also a sufficient amount be sold at public outcry to the highest bidder for a credit of 12 month to pay the indebtedness of said Estate taking note and two good and sufficient Securities.

 

                        Estate of VIRGINIA T. BOUNDS

 

At this day come into court VIRGINIA T. BOUNDS one of the minor heirs of J. M. & ELIZA BOUNDS Deceased being 14 years….

   Ordered by the court that M. S. BOUNDS former Guardian set over and that ANN S. HURT be appointed Guardian of the Person & Estate of VIRGINIA T. BOUNDS and that Letters be granted her when she executes bond for her faithful performance.

 

                        Estate of THOMPSON & ABIGAL HELMS  

 

At this day comes JAMES HELMS by petition one of the heirs of THOMPSON & ABIGAIL HELMS Deceased, praying the court for an order for Partition and Distribution of said Estate and the Court being satisfied that the citation required by law has been given and no reason why same Estate should not be distributed.

It is ordered by the Court that A. T. ROBINSON, GRANDERSON SHAWVER and J. S. NOBLES be and they are hereby appointed commissioners to partition and distributed said Estate between JAMES HELMS, AXIA ANN HELMS, GEORGE W. HELMS, SARAH E. HELMS, FRANCES M. HELMS, WILLIAM HELMS & JOHN HELMS, all the real and personal Estate equally between such heirs consisting of Six Hundred & forty acres of land and Fourteen Hundred & fifty Three dollars & Seventy five Cents (special) now in the hands of W. W. HERRON Guardian of the said minor heirs which amount to be equally divided among such heirs after deducting all cost of Partition &c.

The said Commissioners will set apart the interest of the deceased heirs to wit JOHN HELMS & WILLIAM HELMS and then shall proceed to distribute the shares given to the said deceased heirs equally among the Surviving heirs.

                        The court then proceeds to a certain the amount of advancement that has been made to each heir and it appearing that that they have received as follows AXIA ANN HELMS has received one hundred & thirty four Dollars & fifty nine cents ($134.59)

   It is further ordered by the court that W. H. HERRON Guardian of the said minors (unreadable) represent their interest and receive their shares.

            The said Commissioners will proceed to distribute said property according to that (?)…

                        Estate of JOHN W. PARKER Deceased

 

This day comes W. C. PARKER administrator of the Estate of JOHN W. PARKER Deceased and the Notice of application for final Settlement having been given according to law the Court proceeded to consider the account of the said administrator and after duly examining the vouchers produced It is ordered by the court that the Said account be approved and allowed excepting the sum of Six Dollars paid to (blank) LEAR/LED. It is further ordered and adjudged by the Court that the said W. C. PARKER be allowed his administration account to the amount of fifty one Dollars as commission and compensation then comes on to be heard the application of the said W. C. PARKER for Partition and distribution of the Estate intestate JOHN W. PARKER Deceased and it appearing to the Court that all of the debts against Said Estate have been paid and no reason appearing why said Estate should not be distributed It is ordered by the Court that GEORGE WHITE, SAMUEL WILKINS and WILLIAM SACHSE proceed as Commissioners to partition and distribute Said Estate between MARY E. PARKER deceased and of the person and Estate one third to be given to said widow and the remainder of both real and personal property of the Separate Estate to be divided equally among the aforesaid heirs the court then proceeded to a certain the advancements and it appearing that they have received as follows: W. C. PARKER 157.50 THOMAS PARKINS [PARKER?] Widow M. G. PARKER $145 Also amount due on Note to the Estate $111. Lot at $156 SARAH WILSON $155, DAVID PARKER Decd. One Stud (?) (unreadable) to be placed in (unreadable) SAML. PARKER $20. In addition to the advancement to W. C. PARKER there shall be deducted from his share the sum of $60 15/00 amount due by him to the Estate for the hire of Negro, also deduct from the Share of the Widow M. E. PARKER the sum of $14 due the Estate for hire of negro.

            The said commission will set apart the interest to the Two deceased heirs to wit DAVID PARKER and LOUISIANA PARKER and than shall proceed to distribute the Shares given to the said Deceased as follows of the share of DAVID PARKER shall be given to W. C. PARKER, SARAH WILSON, ELIZA SIDWELL and SAMUEL PARKER, Brothers and sisters of the full blood one full Share each and to M. E. PARKER JR., LAWRENCE PARKER, LAURA B. PARKER and DESMONIA PARKER Brothers and Sisters of the half blood an half share each, of the share of LOUISIANA PARKER her mother MARY E. PARKER shall receive one half and the other half to be given as follows to her Brothers & Sisters of the full blood, to wit M. E. PARKER JR., LAWRENCE PARKER, LAURA B. PARKER and DESDOMIA PARKER one share each and to the brothers and sisters of the half blood to wit W. C. PARKER, SARAH WILSON, ELIZA SIDWELL and SAMUEL PARKER an half share each.

            The said commissioners will proceed to divide said property as given so that inventory of said Estate in accordance with the foregoing order and report that next term of the court.

            And it is further ordered by the court that W. C. PARKER be appointed (unreadable) ad litem of SAMUEL PARKER minor.

At this day comes A. H. NATHERLY Admr. of the Estate of J. D. NELSON Deceased  and by petition prays for the appointment of Commissioners to Set apart to its (?) Surviving wife of said Deceased her interest in said Estate that the remainder may be sold for the payment of Debts.

            And it appearing to the court that the whole of said property is separate property and consists entirely of land It is therefore ordered by the court that D. D. GRHAM, JACOB MOORE & J. O. SHEPPARD be and they are hereby appointed Commissioners to set apart to the surviving wife of said Deceased a life interest in one third of said Estate with exception of seventy five acres of land that is under mortgage to J. W. HAYNES (?) and for description of said lands, references is here made to the Deed to LUCIE (?) NELSON deceased and Inventory of said Estate the said (unreadable) to partition said Estate in accordance with the order of court taking into consideration quality and quantity and making report to the next term of this court.

                        Estate of JONAS DAWSON Deceased

 

At this day comes D. D. DAWSON, J. D. DAWSON and NANCY HUFF the only heirs at law of JONAS DAWSON deceased by petition and pray the court for Partition & Distribution of said Estate and it appearing to the Court that said heirs have obtained the full and entire release from CHARITY DAWSON the widow of said JONAS DAWSON Deceased both separate and community.

            It is therefore ordered by the court that A. T. ROBERSON, J. S. HELMS & W. J. ROBERTS be and they are hereby appointed Commissioners to make partition and distribution of said Estate among the following heirs to wit:  DANIEL D. DAWSON, JAMES D. DAWSON & MARY HUFF all the real and personal Estate equally between said heirs consisting of 287 acres of land the Headright (?) of said Deceased also 276 acres of timbered land part of the Headright survey of THOMAS LINDSEY Situated on the waters of East fork and all other personal property belonging to said Estate for particular description of which reference is (unreadable) made to Inventory  appraisement of said estate.

                        Estate of R. C. WHISENANT Deceased

 

At this day come HUGH WHISENANT by petition and prays the court for an order of sale of sufficient property belonging to said Estate to pay off the indebtedness of said Estate.

                        Ordered by the court that HUGH WHISENANT Admr. of the Estate of R. C. WHISENANT proceed to sell at public auction for cash in hand to the highest bidder the following property belonging to said Estate to pay the cost of Administration amounting to about fifty Dollars, also a sufficient amt of Personal property to pay off the indebtedness of said Estate on a credit of six months to the highest bidder taking Notes and good sufficient security.

At this day comes JOHN NELSON Administrator of the Estate of SAML. BOGART Deceased by Petition in Writing files and Represents and Shows to the court that at the time of Partial Partition of the Estate of said SAML. BOGART Deceased RACHEL BOGART Surviving wife of said Decd. was indebted to Said Estate by Note in the sum of (305) Three hundred and five Dollars and that in said Partition of said Estate Said Note was not take into consideration and that in making Said Partition the commissioners show that thus (?) due said RACHEL BOGART the sum of Two hundred Dollars not taking into consideration the said sum of Three Hundred and five Dollars, and petitioner prays the court for an order of court to credit said RACHEL BOGART’S Note with the sum of Two hundred Dollars as above shown with Interest thereon from the time of Partition and the court proceeded to investigate the same (?) and it appearing to the court that the same is correct and true.

                                                            It is therefore ordered adjudged & decreed by the court that the Prayer of said Petitioner be granted and the said RACHEL BOGART’S Note for Three hundred & five Dollars be credited with the said sum of Two hundred Dollars as prayed by petitioner to take effect on the 21st day of July 1864 being the date of Partition of said Estate.
