I, THOMAS C. MUSE of the County of Pittsylvania & State of Virginia do make my last will & testament in manner and form following.
1st. I desire that my executor hereinafter named shall sell as soon as may be practicable after my decease, the tract of land purchased from Vincent Witcher, and family of negros (negroes) (Betsey & her seven children) purchased from John & Robert Calloway, the land on a credit of one and two years, and the negroes on a credit of twelve months, that he collect all monies debts due me and promptly pay all my just debts or liabilities, including my burial & funeral expenses.
2nd. After the payment of debts aforesaid I give to my beloved son JAMES A. MUSE my entire estate including a negro man named Moses and woman named Jane and her two children, Charles and Mary, as well as all monies on hand, all debts remaining unpaid, and every other species or kind of property or estate to which I may be now or at any future time entitled, provided however, that should the said negro man Moses desire to be sold in order to remain with or near his wife, then and in that case I leave discretionary with my said executor to sell him or not either privately or a auction, for cash, or on time, as he may think best.
3rd. Should my said son JAMES A. MUSE died before he attains the age of twenty one years then and in that event, I give the negro woman Jane and her two children together with their increase if any to my sister, ANGELINE H. MICHELL of the State of Tennessee and all the results of my estate of every kind and description to my niece WINIFORD N. CARTER of the County of Pittsylvania and State of Virginia.
4th It is my will and desire, that immediately upon my decease, my said executor shall take charge and control of my said son, and soon thereafter as my be practionable remove and place him under the care of my beloved brother JAMES S. MUSE of the County of Lafayette and State of Missouri, whom I do hereby nominate and appoint Guardian for my said son, and I do expressly direct that my said executor shall pay over and deliver to my said brother JAMES S. MUSE as guardian in Missouri of said son, all money and property left him in this my will without any qualifications of my said brother as guardian in this state or any order of any Court for the purpose and that the receipt of my aid brother as guardian under his qualification in Missouri shall be a protection to my said Exer. For any such payment or delivery such money or property thus paid over and delivered to my said brother as guardian as aforesaid, I desire shall be held and managed by him either in Missouri or elsewhere, in such manner as he may deem best calculated to protect and advance the interest of my said son.
5th It is my desire that my said brother JAMES S. MUSE shall direct and superintend the education of my said son and in all respects govern and mange him in that way which he may deem proper and best calculated to promote his interest and have the fullest evidence in the capacity and integrity of my said brother, it is my desire that he be allowed to assume and execute the guardianship aforesaid with being required to give any….

whatever either in Missouri or elsewhere for the faithful performance of the trust which I have imposed upon him
And lastly – I do appoint my friend and nephew THOMAS S. MUSE executor of this my last will and testament, trusting that he will endeavor to carry out faithfully and promptly my wishes and instructions as above expressed, in regard to the removal of my beloved son and his estate hereby revoking all other or former wills by me heretofore made.

And at another day to wit – At a County Court continued and held for the County of Pittsylvania on the 21st day of April 1857 the last will and testament of THOMAS C. MUSE deceased was further proved by Achilles H. Moorman another subscribing to be the act and deed of the said THOMAS C. MUSE and was ordered to be recorded, and on the motion of THOMAS S. MUSE the Executor in the said will named who made oath and with ROBT. W. B. MUSE as his security who made oath to his sufficiency entered into and acknowledged a bond in the penalty of Fourteen Thousand dollars conditioned according to law, certificate is granted him for obtaining probate of said will in due form

Of our knowledge & belief that the above foregoing is a just and true account of the sale of the personal property belonging to the estate of the deceased mad by us on the 21st October 1859 and that the terms of said sale was a credit of twelve months.

The undersigned having been appointed commissioners at the last term of your Hon. Court to make partition and distribution of the estate of JOHN H. COLLINS, decd. late of said County would beg leave to report that in accordance with your order they proceeded to make a careful examination and valuation of the estate both real and personal of said COLLINS decd. after which we proceeded to partition and distribution as follows –
To CHAROTTE COLLINS widow of said J. H. COLLINS 279 ½ acres of land valued at $2217.50/100 in two tracts. Tract 1st contains 197 acres and is bounded as follows, Beginning at the NW corner of a 155 acres survey in the name of said COLLINS (?), Thence East 19.50 chains a post on the NW line thereof, Thence South 81.14 chains a post in the prairie, Thence West 29.22 chains a post the SW corner of an 81 acre tract owned by (?), Thence North 40.02 chains the NE corner of the aforesaid 81 acres, Thence East 9.72 chains the SW corner of the aforesaid 155 acres, Thence North 41.14 chains to the place of beginning.
2nd Tract. Containing 82 ½ acres, being a part of a 165 acre survey in the name of said COLLINS and bounded as follows: Beginning at a post the SE corner of said 165 acres, Thence North 29.96 chains the NE corner thereof, Thence West 27.47 chains a post on the NW line thereof, Thence East 27.47 chains to the place of beginning, and one half of the personal property at $377 as follows:

Not susceptible of a division without material injury to the said Heirs. We would therefore recommend that it remain as an undivided interest & (?) value it as follows: 197 acres at $10.00 per acre making $19750 and 82 ½ acres being the remaining half of the 165 acre tract at $3.00 per acre making $247 ½ in the aggregate $2217 50/100. The remaining half of the personal property amounting to $337.56, we also find it impracticable to divide and would recommend a sale of the same. The annexed best (?) gives a correct exhibit of the personal property set apart to said heirs:

Collin County Being sound of mind and memory and for the quiting (sic) of my beloved family in the possession of my estate after my decease I make this my last will and testament in the name of God, Amen.
Namely, after all my just debts and funeral expenses are paid, it is my desire that my wife keep in her possession my home place & a tract of timbered land deeded to me by T. G. KENNEDY on Rowlette Creek, together with all of my household and kitchen furniture, stock &c that I may be possessed of at my death for her support during her natural life time or widowhood.
3rdly. I give to LEWIS L. FINLEY the half of a tract of land situated in Collin County described in letters patent baring (bearing) date 30th March A. D. 1855 No. 379 Vol. 10, 34d Class, the amount of the whole claim is 320 acres, a colony claim, as nearly the half of the above described land as it can be divided (an equal value) and the other half I give to HOWARD H. FINLEY without any conditions as was set forth concerning my home place, (?) that D. MELTON see to taking care of my Bro. JAMES FINLEY, the reason I have not given anything to D. MELTON is I gave him property worth 200 dollars before this will was made and J. MORROW I paid 200 dollars, D. CONROD I paid 200 dollars, SAMPSON FINLEY I paid 200 dollars, JAS. FINLEY I paid 200 dollars & WM. FINLEY I paid 200 dollars.

At this day comes Thomas G. Kennedy one of the attesting witnesses to the last will and testament of Thomas Finley now exhibited for probate and being duly sworn in open court says that he is and was at the time of his signing said Will as an attesting witness over the age of fourteen years that said will was executed by said THOMAS FINLEY by signing his name thereto in his own proper person that the body of said will was not wholly written by said Finley but the same with the exception of said signature of said Finley was written by this affiant, who in conjunction with P. H. SPRADLEY the other subscribing witness attested the same as now appears on the face of said will by subscribing their names in the presence of (?) testator Thomas Finley, this affiant further says that said P. H. SPRADLEY was over the age of fourteen years at the time of his said signature as attesting witness.

To the Hon. George H. Pegues, Judge of the Probate Court of Collin County.
The undersigned would respectfully represent and show that heretofore to wit: at the December Term 1857 of the Probate Court & by order of your Honor he was authorized and directed to sell 33 ¼ acres of land a part of the headright of MAIZE R. FOSTER decd. for the purpose of setting off & discharging the outstanding debts against the estate of MAIZE R. FOSTER decd. together with costs & expenses, the undersigned would respectfully show that in obedience to the order of your Honor aforesaid he offered the aforesaid 33 ¼ acres to the highest bidder for sale after due and lawful notice on the 2d day of February 1858 and H. H. GOSSUM being the highest & best bidder the same was proclaimed by public proclamation as his property at the sum of ten dollars & 56 cts. Per acre amounting in the aggregate to the sum of $351.12 for which he took the aforesaid H. H. GOSSUM’S note with good security payable in twelvemonths after the date of sale, all of which is respectfully referred to your Honor for confirmation.

Estate of M. R. FOSTER, decd.
State of Texas By virtue of an order of the Probate Court of the aforesaid County made
Collin County at its June term 1857, I proceeded according to law and on the 4 day of August 1857 put up at publick (sic) auction at the Court House dore (door) in the town of McKinney 90 acres of land belonging to the Estate of MAYZE R. FOSTER, deceased. The apprised land was bid off to MANLEY S. BECK at $3.50/100 pr. acre amounting in all to the sum of three hundred and fifteen dollars on 12 months credit, this August 31st, 1857.
