            The undersigned having been appoint at the May Term your Hons. Court [to] make partition and distribution on R. MUGG decd. would respectfully beg leave to offer the following report, to wit:

            After repairing to the premises and making a complete examination of the same we do partition to the respective heirs as follows:

Mugg Thence E 29.61 chains to the North West corner of a twenty acre tract deeded to Samuel French by R. Mugg Thence North 41.76 chains to the place of beginning the Timbered land belonging to said estate consists of 60 acres and is a part of the Headright survey of Henry Hohn. It is situated in the East Fork bottom and in consequence of the recent inundation of the bottom we are unable to survey it. We have partitioned it nevertheless; we will further beg leave to state to the Court that we found the E B line 184 chains West from where we supposed it to be in making a former partition of said estate, we take the liberty of correcting the field notes of a 5 ½ acre tract set apart to Mrs. Mugg in the report of said partition so as to compare with the corrected line.

            The undersigned commissioners appointed by the Honorable County Court of Collin County at the May Term for 1866 to partition and distribute the Community property & estate of JOHN W. & CATHERINE SMITH deceased have had the same under consideration and would respectfully submit the following report.

            1st having had the matter under mature consideration it is their opinion that the land estate is not susceptible [to] division and it further their opinion [of] your commissioners that owing to the condition of the land the widow’s dower cannot be set apart without material injury to the sale thereof is therefore their opinion the land including widow’s dower be sold to the highest bidder which is also the decision of all parties concerned.

            2nd Your commissioners would further report the following as the result of the partition and distribution of personal property of said estate in accordance with your order.
