The State

County of Collin Know All Men by these present, that we, GEO. F. LUCAS as principal and J. L. LOVEJOY and J. H. LOVEJOY as sureties are held and firmly bound unto the Chief Justice of the County of Collin in the sum of Eight Hundred Dollars and (?) cents for the payment of which well and truly to be made, we bind ourselves, our heirs, executors and administrators jointly and severally.
Signed and sealed with our seals being scrawls this the 22d day of February A. D. 1858.
The
condition of the above obligation is such that Whereas the above bounden Geo.
F. Lucas has been appointed by the County Court of said County Guardian of the
person and Estate of the Minor JOHN W.
CHILDERS Heir of ROBERT AND EMILY CHILDRES, decd. late of Grant County,
State of Kentucky.
Now if the said Geo. F. Lucas shall well and truly perform all the duties of Guardian as required of him by law under said appointment then this obligation shall be null and void otherwise to remain in full force and effect.

undersigned John C. Bates [guardian?] and estate of ELIZABETH CHINOWORTH a minor [?] CHINOWORTH Deceased respectfully
reports that in pursuant of [the order] of your Hon. Court made on the thirty
first day of March A. D. 1858 authorizing me as such Guardian to sell certain
Real estate of my said ward. I did on Tuesday the first day of June A. D. 1858
at the door of the Court House in the town of McKinney between the hours of one
and three o’clock in the afternoon of said day offer for sale the real estate
of said Ward described as follows – In Collin County, Texas, Beginning at the
South East corner of the original [headright?] of H. T. CHINOWORTH of 3325
acres lying North East of the Town of McKinney, running thence North 4½º West
31 chains and 65 links a post from which an ash 10 inches in diameter marked X
bears South 16º West 1 chain & four links. Thence West 31 chains and 65
links a post from which an Elm 12 inches in diameter marked X bears South 9½º E
125 links. Thence South 4½º E 31 chains and 65 links a post in the South of
said original survey. Thence East on said South line 31 chains and 65 links to
the place of beginning containing one hundred acres of land.
That more than 20 day before said day of sale I caused notices to be posted in three public places in said County of the time and place of said sale one of which was upon ;the Court house door and two at places outside the Town of McKinney. That at said sale EDWARD HIGBY became the purchaser of said land at the sum of two hundred and ninety seven dollars and fifty cents that being the highest sum bidden, therefore said Higby being the highest bidder said sale was made for cash in hand, and was in all respects fair and regular and in accordance with the terms of said order.

founded as follows to wit: BEGINNING at the NW corner of the aforesaid Three
hundred acre tract a post. Thence East 17 chains a post on the N B line therof
from which an elm 4 in diameter mkd X bears n 25½º E 43 lins. Thence North 5
chains and 90 links to a post from which an 3lm 12 diameter mrd X bears N 23½ E
15 links. Thence West 17 chains to a post on the W B line of said original
survey. Thence South 5 chains and 95 links to the place of beginning. For a
better view of the foregoing subdivisions we would refer you to the sketch map
marked A accompanying this report. The remaining 210 acres after deducting the
widow’s dower we are of opinion after making careful examination cannot be
partitioned without material injury to the heirs. We would therefore recommend
the sale of the same and do appraise said 210 acres at $7.00 per acre amounting
to $1470. the 300 acres set off to the heirs of said heirs. We would therefore
recommend a sale of the same and do appraise it at $7.00 per acre amounting in
the aggregate to $2100.

I will and wish that my remains be interred in a decent manner.

several legatees, (to wit), my beloved wife MARY ELIZA and all our children
according to the laws pf decent and distribution now in force in the State of
Texas – and that the same go not further in court than the probating of this my
last will & testament and to return an inventory of said estate.
34d. It is also my will and wish that my farm remain under the control of my executors hereinafter appointed for the use and benefit of my said wife and the children under his control until our youngest child becomes of lawful age.

And I do hereby constitute and appoint my beloved wife MARY ELIZA LUCAS Executrix in connection with GEORGE F. LUCAS and GABRIEL H. FITZHUGH Executors, and it is my
will and wish that they carry out the foregoing division in accordance with
existante (sic) laws and that they enter on their duties immediately after my
demise.

I also will and direct that whenever my said Exex. May think it expedient to
dispose of any species or piece of property for the benefit or interest of the

all men by these presents, that I, THOMAS
F. BOREN, do make
County of Collin and publish this my last will and testament hereby revoking all former wills heretofore made by me, and first I direct that my body be decently interned in the burying ground in my neighborhood, and as to such worldly estate as it hath pleased God to entrust me with, I dispose of the same as follows.
First direct that all my debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that shall come into the hands of my executor from any portion of my estate.
Also I direct that two hundred acres of land my homestead lying and being in Collin County, State of Texas on the waters of Pilott Grove Fork of Trinity River being a part of the headright survey of Reese P. Murray’s 320 and bounded as follows: BEGINNING one thousand two hundred and sixty varas South of the North East corner of Reese P. Murray’s survey running from thence West four hundred varas. Thence North a sufficient distance to make the said two hundred acres of land running thence West to the West boundary line of said original headright survey. Thence South to the South West corner of said original headright survey. Thence East to the South east corner of said original headright survey. Thence North to the place of beginning to contain the said two hundred acres with all the appurtences thereunto belonging or in anywise appertaining.
Also ten
acres of land deeded to me by Thomas Hart on Indian Creek in Collin County,
State of Texas being a tributary of Pilott Grove fork of Trinity River said ten
acres of land with all the appurtences thereunto belonging and the said two
hundred acres of land as above described shall be and remain the property of my
beloved wife MARY by name so long as she remains my widow, but if she should
marry again or when she dies in either case then the said two hundred and ten
acres of land a herein bequeathed to my said wife shall be and remain the
property of my beloved son THOMAS
and my beloved daughter LELA ANN and

and to share alike.
Also I direct that forty acres of land, it being a part of the said Reese P. the remaining acres of land of the said Reese P. Murrray headright survey that
is not herein bequeathed it being more or less lying North of said Forty acres
of land herein bequeathed to my said daughter MARY MANDY BYBEE. Also one yoke of oxen and one stear (steer) and
one sorrel horse to be sold to pay my debts and funeral expenses and expenses
of administration and after my debts are all paid should there be any of the
proceeds of said sale remaining I direct that it shall be and remain my said
wife’s but should the property as herein described and set apart fail to pay
all my debts and expenses, I further direct that my executor shall sell a
sufficient amount of other personal property belonging to my estate as he may
think best to pay all my debts and expenses. Also I direct that one dark bay
mare colt be and remain the property of my beloved daughter NANCY NELSON. Also I direct one three
year old bay horse and saddle be and remain the property of my beloved son THOMAS. Also I direct that all my household and other personal property
that is no herein bequeathed and set aside to pay my debts and expenses be and
remain the property of my said wife MARY
by name. Also I direct that all the property a herein set apart to pay my debts
and expenses with the rest of my estate be appraised at a fair valuation by
three judicious neighbors to be chosen by my executor. Also I direct that my
executor shall sell at private or public sale at its current value all of said
property as herein set apart to pay my debts and expenses. Also I direct that
the court appoint an executor of this my last will and testament.

undersigned administrator upon the estate of SAMUEL B. BLACKBURN late of said County deceased, respectfully
reports that in pursuance of an order of sale made by the County Court of said
County setting in Probate on the 26th day of October A. D. 1858 he
gave public notice by posting written notices in three public places in said
County more than twenty days before the day of sale hereinafter mentioned, one
of which was on the Court house door and the other two at public places outside
the town of McKinney. That he would on the seventh day of December 1858 between
the hours of ten o’clock A. M. and four o’clock P. M of said day sell at public
auction to the highest bidder the real estate in said order mentioned to wit:

fifty six and fifty seven in Black Seven in the town of McKinney upon a credit
of twelve months and that in pursuance of said order he did on the said 7th
day of December at the outer door of the court house in said County between the
hours of one and four o’clock P. M offer the said lots in one body for sale
upon; the terms aforesaid. That at said sale the said lots were struck off and
sold to EDWARD L. MORRIS of Kaufman County for the sum of one thousand and
thirty five dollars that being the highest sum bidden therefore and the said
EDWARD L. MORRIS the highest bidder. That said sale was in all respects fair
and regular and at the time and place mention in said order and notices all of
which is respectfully submitted.

To the Hon. the Probate Court of Collin County, Texas. December Term 1858.
In
pursuance of an order to us directed by the Hon. the Probate Court of Collin
County bearing date the 4th day of December A. D. 1858 requiring us
to make partition and distribution of the Real estate and personal property of
the Estate of ROBERT SKAGGS deceased.
We leave to make the following report. 1st. That we sent in
pursuance of said order to divide the Real Estate among the heirs of said
estate as mentioned in said order, when we found that the Real Estate was so
situated that the same could not be divided in quality and quantity without
material injury to all concerned. We therefore recommend to the Court that the
same be sold and the proceeds thereof divided as the only means by which
justice cane be done. We beg leave further to report that in pursuance of said
order we did partition and set off to REBECCA
SKAGGS the late consort of Robert Skaggs deceased for and during her
natural life with the remainder to the heirs mentioned in said order and with
the limitation hereinafter mentioned thirty four acres of land bounded as
follows: BEGINNING at the nw corner of Thompson Helms survey of 640 acres.
Thence South thirty nine chains a post in the West line of said survey. Thence
East 14 chains & 767 links a post in the middle of the bed of Honey Creek.
Thence up said creek with the meanders thereof to a point due East of the
beginning. Thence West 3 chains & 13 links to the beginning. We beg leave
further to report that in pursuance of said order we divided among the heirs of
said estate the sum of $455.45 in the following manner, that is to say to NANCY HICKS the sum of $113.86 and to ELIZA JACKSON the sum of $113.86 and to
ASBERRY SKAGGS the sum of $113.86
and to WILSON SKAGGS the sum of $113.86 and after deducting therefrom the
advancements as mentioned in said order and receipts herewith filed we find the
following sum advanced to each, that is to say, to NANCY HICKS the sum of $136.16, to ELIZA JACKSON the sum of $102.11,

making the total sum of $455.45. We beg leave further to report that in
pursuance of said order we divided between the late widow of ROBERT SKAGGS
deceased and the heirs of said SKAGGS deceased the sum of $455.45 in following manner,
that is to say to REBECCA SKAGGS
widow of ROBERT SKAGGS deceased one
third of said sum to wit the sum of $151.81 and then divided the remainder into
four equal parts to NANCY HICKS the
sum of $50.90, to ELIZA JACKSON the sum of $50.90 and to ASBERRY SKAGGS the sum of $50.90 and to WILSON SKAGGS the sum of $50.90 making the total amount of said
Estate. We beg leave further to report that we have divided said $100.00 as
mentioned in said order one third to the widow and the remainder in four equal
parts among the heirs aforesaid that is to say to each the sum of $16.16. We
beg leave to report that we find advanced to the widow REBECCA SKAGGS the sum of $381.00 by the administrator and we find
the amount of the proceeds…

of the personal property that she has an interest in to be
$455.45, on third of which she is entitled as by the order is manifest which is
the sum of $151.81 leaving a balance due the Estate of $229.19 which was paid
over the amount due her, and we find that there is yet in the hands of the
administrator the sum of $33.33 due the said REBECCA SKAGGS which we apply to the payment of the debt due the
Estate leaving a balance due of $195.86 and the land surveyed by us and set
apart for the benefit of the said REBECCA
SKAGGS to be worth the sum of three dollars per acre making in the
aggregate the sum of $102.00 which we apply to the payment of the debt due the
estate and still leaving a balance due the said estate of the sum of $93.86.
